Do you need a local bid writer for Nordic and German tenders? Language, rules and sector fit in 2026

Most public tenders in Sweden, Norway, Denmark, Finland and Germany are written and evaluated in the local language, and only around 5% of EU contracts go directly to a supplier based in another country. In fact, a May 2026, a Stockholm court upheld a city's decision to exclude a bidder partly because its supporting certificates were in English, so native-language capacity belongs at the top of any checklist for a bid partner.

On top of that, thresholds and national rules changed in several of these countries in 2026, and the value of good writing varies by market and sector. This analysis sets out what a bid partner for the Nordics and Germany needs to know, and how to check that it does.

Can you submit a Nordic or German tender in English?

Most Nordic and German buyers ask for their own language. Suppliers from other EU countries have the same right to bid as domestic firms, but Upphandlingsmyndigheten notes the contracting authority states the language in the tender notice, and we have to follow that guidance.

A recent Swedish case shows how strictly that can apply. In judgment 391-26 of May 26, 2026, Stockholm's administrative court reviewed a procurement in which the City of Stockholm required applications in Swedish, attachments included, while accepting established industry terms in English. The city excluded Mercell Commerce AB on two grounds, including financial standing and language, after it submitted ISO certificates written in English.

In Norway, buyers publish notices on Doffin in Norwegian, and Doffin translates them into English before sending them to TED, the EU's tender journal, because TED does not accept Norwegian. In other words, an English notice on TED is no guarantee that English answers will be accepted.

How often do foreign suppliers win public contracts?

Rarely, when bidding directly. The European Court of Auditors found that direct cross-border awards made up around 5% of EU contracts between 2011 and 2021, and it named language barriers and the number of procurement platforms among the obstacles. The Commission's later evaluation of the procurement directives found that indirect cross-border procurement accounts for around 20%, mostly through local subsidiaries or partners.

In Sweden, small and medium-sized companies made about 75% of the bids and won about 75% of contracts in 2024. Denmark is a partial exception, where the competition authority reports that foreign companies are winning a growing share of contracts. For a supplier entering a new country, the practical route is usually a local entity or partner, with bids written in the buyer's language.

What rules and thresholds should a bid partner know in 2026?

Finland's government reports that 40% of Finnish tenders attract two bidders or fewer, and the new law means an open, above-threshold tender with only one bid should in principle be run again. A partner that knows this can advise when a thin field is likely to reopen.

Sweden averaged 4.6 bids across 17,575 advertised procurements in 2024. Danish contracts drew 3.4 bids on average in 2023, in line with the 2018 to 2022 average. Across the EU, the average fell from 5.7 bidders in 2011 to 3.2 in 2021. Germany does not publish a comparable figure in its summary statistics, but its market is large and spread out, with 199,334 awards worth €135.2 billion in 2024 and about 53% of awards made by municipalities.

Do you need a lawyer or a bid writer?

Most suppliers need a bid writer, and some also need legal advice. Sweden logs about 3,600 procurement challenges a year, with 3,643 review cases filed in 2025, yet suppliers won in whole or in part in only 7.5% of first-instance cases in 2024. A challenge is rarely a substitute for a compliant bid.

Some Nordic firms combine both skills. Tenders Sweden AB, founded in 2005, describes itself as a business law consultancy with lawyers on the team, while MG Procurement Consulting highlights Swedish and Finnish language skills and experience on the contracting-authority side. If your sector sees frequent disputes over evaluation or qualification, a partner with legal depth is worth the higher cost.
